Robert Whitney maintains a general civil and commercial litigation practice, with a focus on insurance litigation. Robert has experience handling cases involving life insurance, property, and commercial general liability policies.
While in law school, Robert served as an executive editor for the Duke Forum for Law and Social Change and was a member of the Guantanamo Defense Clinic. As an undergraduate, Robert completed study abroad programs in Australia and South Africa. Before joining the firm, Robert gained experience as a volunteer in the Office of the Public Defender in Raleigh, NC and as a judicial law clerk for three magistrate judges in the Eastern District of North Carolina.
Robert is an avid fan of college football, college basketball, baseball and soccer. He is, of course, a fan of the Tar Heels. Robert will watch or attempt to play just about other organized sport. He also enjoys traveling, hiking throughout Northern California, watching movies, and reading novels.
Represented several carriers on coverage dispute over the historic $50 million cleanup of the San Diego Harbor.
Negotiated favorable settlement in favor of a property owner in a multi-million dollar slip-and-fall claim.
Successfully achieved dismissal, with prejudice, of claims for breach of contract, bad faith, and conspiracy against life insurer.
Negotiated favorable mediated settlement in favor of financial advisor in a suit for professional negligence, fraud, and breach of fiduciary duty.
Obtained dismissal, with prejudice, in favor of life insurer on claims for breach of contract and bad faith in a policy lapse case.
