John Burnite has more than 20 years of litigation experience, predominately handling insurance coverage, bad faith and punitive damage matters. John also represents insurers, plans, and employers in ERISA claims involving group disability and life insurance disputes. His litigation background encompasses cases relating to general liability, product liability (including medical devices), ADA, elder (financial) abuse, fraud, Business & Professions Code 17200 claims, rescission, interpleader, and declaratory relief. He also assists clients with fraud and arson investigations, and has taken EUOs.
John has secured successful resolutions for clients at every phase of litigation from pleadings, to summary judgment, and through trial. For example, in August 2017, he obtained a judgment of dismissal when a client’s demurrer was sustained without leave to amend. In his last trial, a federal judge found that an insured committed material misrepresentations during the presentation of an insurance claim and judgment therefore was entered in favor of the insurer to affirm the voidance of the policy and to dismiss the breach of contract and extra-contractual claims.
