Benjamin Plaut is a Senior Attorney in the Houston office. Mr. Plaut has won trials before juries, judges, and in administrative forums. He has represented major corporations and small businesses in commercial litigation.
Mr. Plaut began his career as an Assistant District Attorney for Harris County, Texas. He has been part of internal investigations at major companies, and has successfully defended individuals and corporations against claims of wrongdoing in both civil and criminal cases. He is a member of the National Association of Criminal Defense Lawyers.
During a five-year television news career, Mr. Plaut covered trials for network affiliates in Corpus Christi and Beaumont, Texas. He served as the main anchor for the CBS affiliate in Montgomery, Alabama. He is a member of SAG/AFTRA.
Mr. Plaut enjoys tournament poker and golf. He played golf and football at Brown. He ran five consecutive Los Angeles Marathons from 2010 through 2014, including a top 15% finish in 2014.
Won complete defense trial verdict for California manufacturer before Texas administrative law judge. Victory included written opinion foreclosing appeal.
Won return of complete ownership, use and licensing rights to California software developer in pre-complaint settlement.
Won pre-complaint settlement for Houston printing company in dispute with U.S. affiliate of international manufacturer. Manufacturer agreed to provide new commercial printing equipment.
Won (as part of trial team) complete defense trial verdict for corporate and individual clients, including attorneys’ fees, in seven week arbitration before Independent Film and Television Alliance panel in Los Angeles. Victory included unanimous three-panelist written opinion foreclosing appeal.
Won return of investment in Eastern Europe for American-based financier upon discovery of undisclosed facts.
Won pre-trial dismissals in felony and misdemeanor criminal cases including financial crimes, and a grand jury no bill in a death case.
Took nearly 100 plaintiff depositions and co-designed settlement evaluation formula in chemical plant accident case.
Helped win summary judgment for police officer accused of civil rights violation in the United States District Court for the Southern District of Texas.
Helped represent major brewer in federal and state litigation, and assisted in drafting and roll-out of new nationwide distributor agreements.
Helped internal investigation at non-alcoholic beverage company.
Monitored jury selection and trial for private clients.
